Terms of Service

1. The Service

Mikey AI provides an AI-assisted prior authorization management platform that connects to your EHR system to pull patient charts and generate prior authorization forms. We're here to save your practice time and reduce administrative burden.

2. Your Account

• You must be an authorized representative of a licensed healthcare practice to use Mikey AI.
• You're responsible for keeping your login credentials secure.
• You agree to provide accurate information when creating your account.
• We may suspend accounts that violate these Terms or applicable law.

3. Acceptable Use

You agree to use Mikey AI only for its intended purpose — managing prior authorizations for patients under your care. You agree not to:

• Use the platform for any unlawful purpose or in violation of HIPAA.
• Attempt to access patient data you are not authorized to access.
• Reverse engineer, scrape, or copy any part of the platform.
• Interfere with the platform's operation or security.

4. Patient Data and Privacy

We take privacy seriously. Our handling of Protected Health Information (PHI) is governed by our Business Associate Agreement, which is a required component of our relationship.

De-identified data: We may generate de-identified, aggregated data from platform activity (with all personal and patient identifiers removed in accordance with HIPAA's Safe Harbor standard). This de-identified data is not PHI and may be used to improve our platform, conduct research, and for other business purposes — including sharing with third-party partners such as research organizations and pharmaceutical companies. This data cannot be traced back to any individual patient or practice.

We will never sell or share identifiable patient data. Ever.

5. AI-Generated Content

Prior authorization forms generated by Mikey AI are created using AI and should be reviewed by a qualified clinician before submission. Mikey AI is a tool to assist your practice — clinical and administrative decisions remain your responsibility. We do not guarantee that any prior authorization will be approved by an insurance carrier.

6. Billing

Specific pricing and billing terms are provided at the time of subscription. You authorize us to charge the payment method on file for any fees you incur. We'll give you reasonable notice of any price changes.

7. Availability and Changes

We work hard to keep Mikey AI available and improving. We may update, modify, or temporarily suspend the platform from time to time. We'll try to give advance notice for significant changes. We're not liable for downtime or service interruptions outside our reasonable control.

8. Disclaimers and Limitation of Liability

Mikey AI is provided "as is." We don't warrant that the platform will be error-free or that every prior authorization form will be accurate. To the extent permitted by law, our liability for any claim related to the platform is limited to the fees you paid us in the three months preceding the claim.

We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

9. Termination

You may cancel your account at any time by contacting us. We may terminate your access if you materially breach these Terms. Upon termination, your access to the platform will end and we will handle your data in accordance with our Business Associate Agreement.

10. General

• Governing Law. These Terms are governed by the laws of Delaware and applicable federal law.
• Updates. We may update these Terms from time to time. Continued use of the platform after notice of changes constitutes acceptance.
• Entire Agreement. These Terms, together with our Business Associate Agreement, constitute the entire agreement between you and Mikey AI.
